Building Safety Act 2022 (BSA) Explained

The BSA reshaped building safety in England. It created the Building Safety Regulator (BSR) within HSE, introduced new dutyholder roles and set a tougher regime for higher-risk buildings. In occupation, these are residential buildings that are 18 metres or 7 storeys or more with at least two homes. For design and construction, the higher-risk definition also captures hospitals and care homes that meet the same height thresholds.

If you are a client, principal designer, principal contractor or an accountable person, you must keep a digital “golden thread” of building information, manage fire and structural safety risks, and be ready to evidence control through a safety case report and, when directed, a Building Assessment Certificate. The regime is enforced by the BSR.

What is a Building Assessment Certificate?

A Building Assessment Certificate (BAC) confirms to the BSR how you are managing building safety risks in an occupied higher-risk building. You apply only when the BSR tells the principal accountable person to do so. The application draws on your golden thread and safety case report, along with evidence of resident engagement and complaints handling.

BSA Support or Traditional Compliance Routes?

Warranties and legacy compliance checks reduce financial risk, but they are not a substitute for statutory duties under the BSA. The Act places legal responsibilities on clients, designers, contractors and accountable persons to plan, manage and monitor building work, keep prescribed records and control safety risks in occupation.
